Agreement to Terms
These Terms of Service govern your access to and use of KaleidoForge's AI-powered content generation platform, including its website and related services. The service is provided by KaleidoForge, operated by an individual sole proprietor based in California, United States.
By accessing or using the service, you agree to be bound by these Terms. If you do not agree, you may not use the service.
When using KaleidoForge, you agree to:
- Use the service only for lawful purposes and in accordance with these Terms
- Maintain the security of your account credentials
- Provide accurate information when creating your account
- Use generated content responsibly and ethically
- Respect the intellectual property rights of others
- Not share your account with unauthorized users
You may not use KaleidoForge to:
- Generate content that is illegal, harmful, threatening, abusive, or discriminatory
- Create spam, phishing content, or deliberately misleading information
- Infringe on intellectual property rights or violate the privacy of others
- Attempt to reverse engineer, decompile, or interfere with our systems
- Use automated systems to access the service without permission
- Resell or redistribute the service without authorization
- Generate content that impersonates real individuals without their consent
Content ownership and rights:
- You retain ownership of the original content you input into KaleidoForge
- To the extent permitted by law, you own the content generated for you and may use it for personal and commercial purposes
- You are responsible for ensuring your use of generated content complies with applicable laws and third-party rights
- KaleidoForge retains all rights to its software, branding, logos, and underlying technology
- You grant us a limited license to process your content solely to provide the service
Important information about AI outputs:
- KaleidoForge uses third-party AI models to generate content
- AI-generated content may contain inaccuracies, errors, or unintended material
- You are solely responsible for reviewing, editing, and verifying any content before you use or publish it
- We do not guarantee the accuracy, originality, or fitness of generated content for any particular purpose
- You are responsible for ensuring generated content does not infringe others' rights
Payment terms and conditions:
- Subscription fees are billed in advance on a monthly basis through Stripe
- 14-Day Money-Back Guarantee: you may request a full refund within 14 days of your initial subscription purchase by emailing support@kaleidoforge.ai
- After the 14-day period, fees are non-refundable except where required by law
- We may change pricing with 30 days notice to existing subscribers
- Failure to pay may result in suspension of your access
- You are responsible for any applicable taxes
- Cancellation takes effect at the end of your current billing period; you keep access until then
Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, KaleidoForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, resulting from:
- • Your use of, or inability to use, the service
- • Any unauthorized access to or use of our servers or your data
- • Any interruption or cessation of the service
- • Any bugs, viruses, or harmful code transmitted through the service
- • Any errors, inaccuracies, or omissions in content generated by the service
To the extent liability cannot be excluded, our total liability is limited to the amount you paid us in the 3 months preceding the claim.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.
